Hmm. To demonstrate an infringement here, I suspect the burden of proof
is "beyond a reasonable doubt" (copyright infringment, rather than
contractual breach) and that a presumption of innocence therefore
applies. You'd actually have to demonstrate that an EXE built from the
downloaded code behaves materially differently to an auto-generated EXE.

I don't know how Fog Creek has implemented this, but consider something
equivalent to "HOST=foo.fogcreeeksoftware.com PORT=1234 make". The
waters may be a little more muddied if they're not publishing the means
(and perhaps the VNC-derivative tool) of modification.
